 Delhi Gang Rape and Murder Case, 2012



1. Case Overview

The Nirbhaya case is one of the most significant criminal cases in India. On 16 December 2012, a 23-year-old physiotherapy student and her male friend boarded a private bus in South Delhi. The woman was sexually assaulted and both victims were subjected to severe physical violence. They were subsequently thrown from the moving bus.

The victim sustained severe injuries and was initially treated in Delhi. She was later shifted to Mount Elizabeth Hospital in Singapore, where she died on 29 December 2012.

2. Victim

A 23-year-old physiotherapy student, widely referred to as “Nirbhaya” in the media.

Her identity was protected under Indian law.

3. Accused

Six persons were arrested in connection with the case:

Ram Singh

Mukesh Singh

Vinay Sharma

Pawan Gupta

Akshay Kumar Singh

One juvenile, who was tried separately under the applicable juvenile justice system.

4. Biological Evidence and Forensic Examination

Biological evidence is of major importance in sexual assault investigations. In this case, forensic examination involved biological samples and exhibits relevant to establishing the identity of individuals and the circumstances of the offence.

5. Forensic Biology and Serological Examination

A. Serological Examination

Serological examination is used to detect and identify biological materials such as blood and seminal material.

Acid Phosphatase Test – a presumptive test used for the detection of seminal material.

Prostate-Specific Antigen (PSA/p30) Test – used as an additional test for the detection of seminal material.

ABO Blood Grouping – used for determining the blood group of suitable biological samples.

Presumptive and confirmatory tests for blood – used to detect and establish the nature of blood evidence.

B. DNA Profiling

DNA analysis is an important tool in forensic biology for establishing associations between biological evidence and individuals.

Extraction of DNA from suitable biological samples.

Preparation and analysis of DNA profiles.

STR (Short Tandem Repeat) profiling of suitable samples.

Comparison of DNA profiles obtained from evidentiary samples with reference samples.

Evaluation of the genetic association between the biological evidence and the individuals examined.

6. Forensic Findings

The forensic examination provided important biological and DNA evidence relevant to the investigation.

Biological examinations detected biological material relevant to the case.

DNA profiling enabled comparison of evidentiary samples with reference samples of the accused.

The DNA evidence provided scientifically significant associations between the biological evidence and the persons examined.

The forensic findings, together with other evidence, supported the investigation and subsequent court proceedings.

7. Role of Forensic Biology and Serology

Forensic Biology and Serology played an important role in the investigation by:

Detecting and examining biological evidence.

Assisting in the identification and evaluation of biological material.

Providing DNA profiles for comparison with reference samples.

Establishing scientific associations between biological evidence and individuals.

Supporting the investigation and interpretation of biological evidence.

Providing objective scientific evidence for consideration by the court.

8. Court Judgement

The adult accused were tried by the Trial Court and were convicted. The convictions were subsequently upheld by the Delhi High Court and the Supreme Court of India.

Ram Singh died while the trial was in progress. The juvenile accused was tried separately under the applicable juvenile justice law.

The four adult convicts—Mukesh Singh, Vinay Sharma, Pawan Gupta and Akshay Kumar Singh—were executed on 20 March 2020 following the completion of the legal proceedings and rejection of their mercy petitions.

9. Conclusion

The Nirbhaya case demonstrates the important role of Forensic Biology, Serology and DNA Profiling in the investigation of serious crimes. Biological evidence can provide valuable scientific information regarding the presence and nature of biological material, while DNA profiling can establish strong associations between evidentiary samples and individuals.

The case highlights the importance of proper collection, preservation, documentation and scientific examination of biological evidence. It also demonstrates how forensic evidence, when considered along with other investigative and legal evidence, can significantly contribute to criminal investigation and judicial proceedings.
